By using this website, submitting a form, requesting a quote, communicating with us, or booking service, you acknowledge that you have read and understood this Legal Disclaimer. This Disclaimer should be read together with our Privacy Policy, any reservation confirmation, written service agreement, and any other terms provided to you before or during service.
If a signed written agreement, reservation confirmation, insurance provision, or mandatory law conflicts with this website Disclaimer, that more specific document or applicable law will control to the extent of the conflict.
How we refer to our drivers
Throughout this Disclaimer, the person who operates the vehicle may be referred to in various ways, including professional driver, private driver, personal driver, the driver, or other similar names. All of these terms refer to the same role, and all are referred to in this Disclaimer as a private driver.

The information on this website is provided for general informational, marketing, and service-description purposes only. It is not legal advice, medical advice, safety advice, insurance advice, tax advice, financial advice, or professional advice of any kind.

Nature of Our Service
Your Car Our Driver provides private driver service in the client's own vehicle, subject to scheduling, service-area availability, driver availability, safety requirements, and written confirmation.
Unless expressly agreed in writing, Your Car Our Driver does not provide any of the following:
- A taxi service
- A rideshare marketplace
- A limousine fleet
- An ambulance service
- Emergency medical transportation
- A healthcare service
- A nursing service
- A caregiving agency
- A security service
- A bodyguard service
- A courier service
- A childcare service
- A vehicle repair service
- An insurance service
References on the website to safety, care, discretion, comfort, trust, professionalism, or peace of mind describe our service standards and intentions. They are not guarantees that every risk, delay, accident, disclosure, inconvenience, medical event, traffic issue, client conduct issue, third-party act, or vehicle issue can be prevented.
Client-Owned Vehicle Responsibility
Your Car Our Driver's model generally involves a private driver operating the client's own vehicle. The client, vehicle owner, or authorized representative is responsible for ensuring that the vehicle is legally available for the requested service and is safe, roadworthy, properly registered, properly insured, fueled or charged, and suitable for the intended passengers and trip.
The client is responsible for disclosing known vehicle issues, mechanical concerns, dashboard warnings, tire problems, brake concerns, steering concerns, registration issues, insurance limitations, special operating instructions, parking restrictions, EV charging limitations, or other facts that may affect the safe or lawful operation of the vehicle.
Your Car Our Driver may decline, delay, suspend, or end service if a private driver or manager reasonably believes the vehicle is unsafe, unlawful, uninsured, not authorized for use, materially different from the vehicle described, unsuitable for the requested trip, lacking required restraints, or otherwise inappropriate for the requested service.
Unless otherwise required by law or a written agreement, Your Car Our Driver is not responsible for pre-existing vehicle conditions, ordinary wear and tear, vehicle defects, maintenance failures, manufacturer issues, client-provided equipment, personal property left in the vehicle, tickets or fees caused by client instructions, tolls, parking charges, valet charges, fuel, charging, or third-party conduct.
Driver Status, Screening, and Confidentiality
Your Car Our Driver's private drivers are W-2 employees, not casual marketplace drivers. Before serving clients, drivers are subject to company screening, background checks, onboarding, internal policies, and written confidentiality obligations, including signed nondisclosure agreements. Every driver signs a nondisclosure agreement; no one drives for us without one.
Driver screening, background checks, nondisclosure agreements, and employment status are important trust safeguards, but they cannot eliminate every possible risk. No screening program or confidentiality agreement can guarantee that every future act, omission, judgment, delay, accident, privacy concern, or misconduct event will be prevented.
Drivers are required to treat client names, passenger identities, addresses, destinations, schedules, family details, business details, appointment information, service notes, vehicle information, personal items, documents, devices, and in-vehicle conversations as confidential service information.
Drivers may not use client information for personal purposes, solicit clients for outside work, disclose private service details, record or photograph clients without authorization, post client information online, or discuss confidential client matters except as needed to perform or support the assigned service, respond to a safety issue, comply with law, or follow company direction.
Executive Confidentiality and Private Conversations
Many clients use Your Car Our Driver while taking business calls, legal calls, medical-related calls, family calls, financial calls, board calls, investment calls, real-estate calls, or other private conversations. Our private drivers are required to respect the client's privacy and to avoid unnecessary participation in private conversations.
Client conversations inside the vehicle are treated as private service information. However, Your Car Our Driver cannot create or guarantee attorney-client privilege, physician-patient confidentiality, accountant-client privilege, therapist-patient confidentiality, trade-secret protection, board confidentiality, or any other legal privilege merely because a conversation occurs during service.
Clients remain responsible for deciding whether a particular call, document review, speakerphone conversation, video conference, visible screen, printed material, or sensitive discussion is appropriate to conduct in a vehicle with a driver present. For highly confidential matters, clients may wish to use headphones, avoid speakerphone, use privacy screens, limit visible documents, or delay the conversation until they are in a fully private setting.
Children and Minor Passengers
Transportation involving minors must be requested, authorized, and coordinated by a parent, legal guardian, or other authorized adult. Your Car Our Driver may require written instructions, authorized pickup and drop-off contacts, emergency contact information, release instructions, school or activity details, and identification of any adult authorized to receive the child.
The parent, guardian, or authorized adult is responsible for providing and properly installing any legally required child safety seat, booster seat, restraint system, or other passenger safety equipment unless Your Car Our Driver specifically agrees otherwise in writing.
Your Car Our Driver private drivers are not responsible for selecting, inspecting, certifying, fitting, or installing child restraints unless a separate written policy expressly says otherwise. A driver may decline or stop service if a legally required child restraint is missing, appears unsafe, cannot be installed safely, or if release or handoff instructions are incomplete or unsafe.
Your Car Our Driver does not provide childcare, babysitting, tutoring, custody supervision, legal supervision, medical supervision, or child-protection services. Transportation of a minor does not replace the responsibilities of the parent, guardian, school, caregiver, coach, or authorized adult.
Your Car Our Driver may decline, delay, or end service if a child cannot be safely transported, if an authorized adult is unavailable for handoff when required, if instructions are unclear, if the child is ill or distressed in a way that requires medical or caregiver attention, or if continuing service would create a safety or legal concern.
Seniors, Vulnerable Adults, and Assisted Transportation
Your Car Our Driver may provide transportation for seniors, older adults, vulnerable adults, and clients who need thoughtful coordination or additional time. We take this responsibility seriously and aim to provide calm, respectful, reliable service.
Unless expressly agreed in writing, Your Car Our Driver does not provide caregiving, nursing care, home-health services, medical monitoring, medication management, toileting assistance, feeding assistance, lifting, carrying, wheelchair transfer assistance, dementia supervision, guardianship services, or emergency response services.
Clients, family members, caregivers, facilities, medical offices, or authorized representatives are responsible for providing accurate information about mobility needs, cognitive concerns, handoff instructions, access instructions, wait-time expectations, emergency contacts, and any limitations that could affect safety.
Your Car Our Driver may decline, delay, suspend, or end service if a passenger requires a level of assistance or supervision that is beyond the driver's role, beyond the vehicle's suitability, not disclosed in advance, unsafe for the driver or passenger, or more appropriate for a caregiver, medical-transport provider, wheelchair-van provider, ambulance, or emergency service.
Medical-Related Transportation
Your Car Our Driver may provide private driver service to and from medical appointments, dental appointments, therapy appointments, surgery centers, hospitals, rehabilitation centers, senior communities, assisted-living communities, or other health-related destinations when appropriate for ordinary passenger-vehicle transportation.
Your Car Our Driver is not an ambulance, emergency medical provider, EMT service, paramedic service, wheelchair-van service, gurney or stretcher service, medical courier, healthcare provider, medical practice, nursing service, or medical decision-maker unless a separate written agreement and applicable licensing expressly state otherwise.
Drivers do not provide medical advice, diagnose conditions, monitor vital signs, administer medication, handle controlled substances, manage oxygen, provide clinical care, lift or transfer passengers, restrain passengers, determine medical fitness for transport, or decide whether a passenger should be discharged, admitted, released, or transported.
Medical emergencies
If a passenger is experiencing a medical emergency, chest pain, trouble breathing, loss of consciousness, severe confusion, severe bleeding, stroke symptoms, serious fall, uncontrolled pain, or any other urgent medical issue, call 911 or seek emergency medical assistance immediately. Do not use Your Car Our Driver as a substitute for emergency medical care.
For medical-related appointments, the client or authorized representative is responsible for determining whether ordinary passenger-vehicle transportation is medically appropriate and whether a caregiver, medical escort, wheelchair-accessible vehicle, ambulance, or other specialized service is required.
Alcohol, Evening Events, and DUI-Prevention Use
Many clients use Your Car Our Driver for evenings, dinners, concerts, sporting events, celebrations, private events, wine dinners, and other occasions where they prefer not to drive their own vehicle home. This can be a responsible planning choice.
Your Car Our Driver does not encourage excessive alcohol consumption, illegal activity, unsafe conduct, or impaired decision-making. Your Car Our Driver does not guarantee that a client will avoid arrest, citation, injury, accident, liability, or other consequences related to alcohol, drugs, impairment, fatigue, unsafe behavior, or law enforcement activity.
Clients and passengers are responsible for their own conduct before, during, and after service. Drivers may decline, pause, or end service if a passenger is violent, threatening, abusive, severely ill, vomiting in a manner that prevents safe transportation, attempting illegal conduct, interfering with safe driving, refusing to wear a seat belt, refusing required safety instructions, or otherwise creating an unsafe environment.
If a passenger's condition creates a safety or medical concern, Your Car Our Driver may contact an emergency contact, event representative, caregiver, hotel, facility, medical provider, law enforcement, or emergency services as reasonably necessary to protect the passenger, driver, vehicle, or public.
Insurance and Liability
When you authorize a YCOD driver to operate your vehicle, the driver does so with your permission as a permissive user under your own auto policy, which remains primary; YCOD's commercial coverage applies in addition to your own. YCOD carries a commercial drive-away liability policy, coverage written specifically for companies whose professional drivers operate vehicles the company does not own, that applies while a scheduled YCOD driver is operating a client's vehicle in the course of our services, along with physical damage coverage for the vehicle itself while in our driver's care. Every YCOD driver is a W-2 employee of Your Car, Our Driver, Inc., covered by workers' compensation insurance as required by California law.
Coverage is subject to policy terms
All coverage described here and elsewhere on this website is subject to the terms, limits, conditions, and exclusions of our applicable insurance policies. The summaries on this site are provided for general understanding only and do not modify, expand, or replace the actual terms of any policy. We are glad to provide proof of our coverage on request.
Service Availability, Timing, and Route Conditions
Website descriptions of availability, service areas, scheduling options, response times, wait times, arrival windows, trip duration, traffic expectations, and route planning are estimates and general descriptions only. They are not guarantees.
Actual service may be affected by driver availability, prior bookings, traffic, accidents, road closures, weather, wildfire activity, police activity, parking conditions, valet delays, venue traffic, gated-community access, airport conditions, school-release procedures, medical-facility delays, client readiness, vehicle condition, or other factors outside Your Car Our Driver's control.
Your Car Our Driver may reschedule, delay, substitute a driver, modify service, or decline a request where necessary due to safety, legal, operational, staffing, weather, vehicle, or client-specific concerns. Any confirmed reservation remains subject to the specific written terms provided at booking.
Pricing, Quotes, Promotions, and Website Offers
Any pricing, packages, examples, minimums, hourly references, promotional statements, refund language, service guarantees, or savings comparisons displayed on the website are general information unless confirmed in writing for a specific reservation.
Final invoice amounts are determined by our published hourly rates and the actual time of service: the hours used, including wait time between stops; the applicable minimum (three hours, or five hours for reservations beginning at or after 6:00 p.m. on New Year's Eve); the vehicle-type rate; overtime rates after eight hours of service; and cancellation timing. For certain remote areas, a travel fee may apply and is disclosed before the reservation is confirmed. Because your driver operates your own vehicle, fuel and tolls are normally paid by you directly (tolls post to your own FasTrak account). If we pay a parking fee, or fuel or charge your vehicle during service, that cost is added to the invoice with the standard 20% convenience fee.
Your Car Our Driver may correct errors, update pricing, modify promotions, withdraw offers, or refuse requests that are inaccurate, outdated, mistaken, unavailable, unlawful, unsafe, or inconsistent with the confirmed service terms.
Testimonials, Reviews, Experience Claims, and Results
Testimonials, reviews, ratings, case examples, experience statements, and service-quality claims on the website reflect individual experiences, company history, or service standards. They do not guarantee that every client will have the same experience or outcome.
Statements such as trusted, professional, discreet, premium, safe, reliable, background checked, NDA, W-2 employees, executive, child, senior, medical appointment, DUI prevention, or similar phrases describe Your Car Our Driver's service model and intended standards, not a guarantee that every risk, incident, delay, concern, or dissatisfaction can be eliminated.
Any testimonials or reviews may be edited for length, spelling, grammar, or clarity, but not in a way intended to materially change the meaning. Where required by law, Your Car Our Driver will disclose material connections, incentives, or relationships related to endorsements or reviews.

Right to Refuse, Pause, Modify, or End Service
Your Car Our Driver may refuse, pause, modify, or end service where reasonably necessary for safety, legality, operational feasibility, vehicle condition, passenger conduct, driver safety, payment issues, incomplete information, lack of authorization, missing child restraints, inadequate handoff instructions, undisclosed mobility or medical needs, severe weather, road closures, unlawful requests, or other legitimate business or safety reasons.
Your Car Our Driver may also refuse requests that would require a driver to violate traffic laws, parking laws, vehicle laws, child-passenger laws, employment policies, confidentiality obligations, safety protocols, or any other applicable requirement.
Any refusal, pause, modification, or termination of service will be handled in a manner intended to respect the client and passengers while protecting safety, legality, and company obligations.
No Warranties Regarding the Website
The website and its content are provided on an as is and as available basis.
